Excise and Taxation Department UT Chandigarh Issues Notices to Clubs/Restaurants for Non-Compliance

In the interest of maintaining transparency and ensuring strict adherence to statutory and regulatory obligations, Department of Excise and Taxation UT Chandigarh has put certain Clubs/Restaurants entities on notice for non-compliance with the established laws and regulations.
The Department of Excise and Taxation UT Chandigarh grants licensee at the approved Premises under Punjab Excise Act, 1914 (as applicable to U.T., Chandigarh) and these licenses have been renewed on year to year basis and presently has been renewed for the current U.T. Chandigarh Excise Policy Year 2024-25 upto 31.3.2025. The license obligates the licensee to abide by the Punjab Excise Act 2014 and the Rules/Orders/ Regulations/Instructions framed thereunder from time to time as applicable to U.T. Chandigarh including the U.T, Chandigarh Excise Policy 2024-25, other instructions / orders/ circulars issued by the Excise & Taxation Commissioner-cum-Financial Commissioner, U.T. Chandigarh and the terms and conditions laid by Chandigarh Administration as well as other rules & regulation of the Government to include the Building Regulations as well as the Noise Pollution (Regulation and Control) Rules, 2000 as applicable to UT Chandigarh.
The Clause 9 and 32 of the U.T, Chandigarh Excise Policy 2024-25 provides:
“Clause 9: All licences, whether for wholesale or for retail sale, shall be granted subject to the provisions of the Punjab Excise Act, 1914 and the Rules/ Regulations/ Instructions/ Policies framed there under from time to time as applicable to U.T., Chandigarh.
Clause 32: All licences, whether for wholesale or retail sale, shall be granted subject to the provisions of the Punjab Excise Act, 1914 and the Rules/Orders/ Regulations/Instructions/Policies framed thereunder from time to time as applicable to U.T. Chandigarh and all other instructions / orders/ circulars issued by the Excise & Taxation Commissioner-cum-Financial Commissioner, U.T. Chandigarh from time to time.
The Clause 80 (C) of U.T. Chandigarh Excise Policy for the year 2024-25 provides:
“80. (C) In case, any department of Chandigarh Administration, withdraws the NOC given to any licensee, the excise department may withdraw the License, after giving opportunity of hearing.”
The Punjab Intoxicant License and Sales Orders, 1956 (as applicable to U.T., Chandigarh) provides:
“F – Procedure to be followed and matter to be ascertained before any licence is granted for the retail vend of liquor for consumption on the premises
11. The Collector shall also ask for the opinion of all Superintendent of Police”.
The Department is now in receipt of a letters dated 28.11.2024 and 6.12.2024 from Senior Superintendent of Police, U.T., Chandigarh:
As per the said letters dated 28.11.2024 and 6.12.2024 from Senior Superintendent of Police, U.T., Chandigarh the below mentioned establishments/licensees have been found violating the Noise Pollution (Regulation and Control) Rules, 2000 repeatedly therefore the SSP has withdrawn their NOC/consent regarding operations of the license at their said premises. The Senior Superintendent of Police, U.T., Chandigarh in the said letter has also requested that appropriate action be taken by the Excise & Taxation Department, U.T., Chandigarh.

- As per the letter of from Senior Superintendent of Police, U.T., Chandigarh dated 28.11.2024 has informed that the below mentioned establishments/licensees have been found violating the Noise Pollution (Regulation and Control) Rules, 2000 therefore the Senior Superintendent of Police, U.T., Chandigarh in the said letter has requested that appropriate action be taken by the Excise & Taxation Department, U.T., Chandigarh.

The Section 36 (c) of the Punjab Excise Act, 1914 (as applicable to U.T., Chandigarh) provides:
36. Power to cancel or suspend licences, etc. – Subject to such restrictions as the State Government may prescribe, the authority granting any licence, permit or pass under this Act may cancel or suspend it.
(c) in the event of any breach by the holder of such licence, permit or pass or by his servants, or by any one acting on his behalf with his express or implied permission, of any of the terms or conditions of such licence, permit or pass
NOC by the Senior Superintendent of Police, U.T., Chandigarh having been withdrawn (from the establishments mentioned at 5 (a) above) vide letters dated 28.11.2024 and 6.12.2024, therefore Excise & Taxation Department, Union Territory, has issued notice to these establishments directing them to appear through their authorized representative before the Collector (Excise), Excise & Taxation Department, Union Territory, Chandigarh on 16.12.2024 at 3pm to show cause as to why their license be not canceled or suspended u/s 36(C) of the Punjab Excise Act, 1914 (as applicable to U.T., Chandigarh) and the Rules/Orders/ Regulations/Instructions framed thereunder from time to time as applicable to U.T. Chandigarh including the U.T, Chandigarh Excise Policy 2024-25 and all other instructions / orders/ circulars issued by the Excise & Taxation Commissioner-cum-Financial Commissioner, U.T. Chandigarh from time to time.
It is made clear that in case of failure to appear on the said date and time, it will be presumed that you have nothing to say in this regard and ex-party decision on merit will be taken accordingly.
- In view that the Senior Superintendent of Police, U.T., Chandigarh vide letter dated 28.11.2024 has informed that the establishments at 5 (b) above have been violating the Noise Pollution (Regulation and Control) Rules, 2000, therefore vide this notice they have been directed to appear through their authorized representative before the Collector (Excise), Excise & Taxation Department, Union Territory, Chandigarh on 17.12.2024 at 3pm to show cause as to why the license granted to them should not be canceled or suspended u/s 36(C) of the Punjab Excise Act, 1914 (as applicable to U.T., Chandigarh) and the Rules/Orders/ Regulations/Instructions framed thereunder from time to time as applicable to U.T. Chandigarh including the U.T, Chandigarh Excise Policy 2024-25 and all other instructions / orders/ circulars issued by the Excise & Taxation Commissioner-cum-Financial Commissioner, U.T. Chandigarh from time to time.
It is made clear that in case of failure to appear on the said date and time, it will be presumed that you have nothing to say in this regard and ex-party decision on merit will be taken accordingly.

- In addition the Excise Department is continuing its drive against illegal smuggling of liquor to ensure integrity of supply chain of liquor. Dedicated Excise teams consisting of ETOs and ETIs formed to keep vigil and check liquor outlets and the wholesale traders, today inspected and checked the L1F and L-DF warehouses premises of various wholesale traders – the Department will act swiftly taking stringent action against the perpetrators
