Manish Tiwari Raises Concerns in Lok Sabha Over Ban on Sale of Jointly Owned Properties in Chandigarh

Chandigarh MP and former Union Minister Manish Tiwari has raised concerns in the Lok Sabha regarding the difficulties faced by individuals when selling jointly owned properties in the city. In a written question to the Ministry of Home Affairs, Tiwari sought clarification on whether the Chandigarh administration imposed a ban on the sale of such properties after a Supreme Court ruling on January 10, 2023. The ruling had prohibited the conversion of single units into multiple apartments and the registration of co-ownership agreements.
Tiwari questioned whether the Supreme Court’s decision explicitly prohibited the sale of jointly owned properties, noting that the ruling did not appear to address this matter directly. He also highlighted the financial hardships faced by property owners who, due to medical emergencies or family needs, were forced to sell their properties at a loss to co-owners.
In his query, Tiwari further asked why the Chandigarh administration had not revoked the February 9, 2023 notification or sought clarification from the Supreme Court on the matter.
Responding to the query, Minister of State for Home Affairs Nityanand Rai informed the House that the issue was currently under consideration by the Punjab and Haryana High Court, and thus no final decision could be made at this stage.
